Rules and Regulations

    How to Enter
  1. Beginning on September 21st, 2008, participants are invited to record a video postcard at the Canadian Pacific Spirit Train Video Booth telling us about their Olympic spirit. Visit the Canadian Pacific Spirit Train Video Booth in the Spirit Train Village coming to a town near you. For event dates and location details, please visit www.cpspirittrain.com.
  2. By entering this contest, the participants agree to have their video postcards posted online at www.cpspirittrain.com.
  3. NO PURCHASE NECESSARY TO ENTER.
  4. Eligibility
  5. This contest is open to all Canadian residents who have reached the age of majority in the province or territory where he/she resides, excluding employees and their immediate family members, contractors, agents or representatives of Canadian Pacific or its affiliated or related companies and any person who resides with the foregoing persons. “Immediate family” is defined as parents, siblings, children or spouse.
  6. Contest opens 12:01am MST on September 21st, 2008 and closes 11:59pm MST on October 18th, 2008.
  7. Participants are only eligible to enter once.
  8. The Prize
  9. There is (1) one Grand Prize package available to be won. The Grand Prize package includes one trip for four (4) to the Vancouver 2010 Olympic Winter Games from February 16, 2010 to February 18, 2010. The approximate value of the Grand Prize package (including airfare) is $10,000.00 CAD. The approximate value is based upon return flights from Newfoundland and therefore the approximate value may be slightly lower where the winner resides closer to Vancouver. In the event the Grand Prize winner resides within a 200km radius of Vancouver, the Grand Prize will be deemed not to include airfare and the Grand Prize winner will instead be provided with car service from his/her residence to the Royal Canadian Pacific Luxury Train and the return trip from the Royal Canadian Pacific Luxury Train to the Grand Prize winner's residence. The approximate retail value of the Grand Prize not including airfare but including car service, is $8,000 CAD.

    Prize details:

    • Four (4) round trip coach class airline tickets to Vancouver from the Canadian airport which is closest to the winner's place of residence and where Air Canada flies;
    • Two (2) nights accommodation for four (4) aboard the Royal Canadian Pacific Luxury Train;
    • Four (4) tickets to one competition session in each of: women’s ice hockey, men’s ice hockey and speed skating. Use of these tickets is subject to compliance with all rules and regulations of general application established by VANOC. Tickets may not be sold at a price greater than face value and may not be used for any commercial or promotional purposes.
    • $500 cash for spending money; and
    • Canadian Pacific Vancouver 2010 Olympic merchandise.

    The prize must be used during the Vancouver 2010 Olympic Winter Games between February 16th to February 18th, 2010. The Grand Prize package may not be redeemed for cash. Winner and travel companions are responsible for all costs and expenses not listed above, including without limitation travel while in Vancouver, taxes, fees, meals, insurance, gratuities, valid travel documentation, transfers to and from the Royal Canadian Pacific Luxury Train and all personal expenses.

  10. Draw
  11. The Grand Prize winner will be determined by a random draw from all eligible entries. On November 3, 2008 at 10:00am MST, a random draw will be conducted by a representative of Canadian Pacific for the Grand Prize package. The selected entrant must correctly answer a mathematical skill-testing question and have complied with all conditions of the contest rules and regulations.
  12. The selected entrant will be contacted by phone and/or email within 5 days of the draw. If the selected entrant is unable to be contacted after 3 attempts via email and/or phone by November 30, 2008, at the sole discretion of Canadian Pacific, he or she forfeits the Grand Prize and another entrant will be randomly selected.
  13. General Rules
  14. All contestants must have completed the on-site video registration, including providing his/her name, phone number and valid email address. His/her video must not contain any unacceptable clothing or adornments, or display any commercial/corporate advertising (including but not limited to corporate logos, brand names, slogans, political, personal and religious statements) and must not contain defamatory statements (including words or symbols that are widely considered offensive to individuals of a certain race, ethnicity, religion, sexual orientation, or socioeconomic group); must not include threats to any person, place, business, or group; must not invade privacy or other rights of any person, firm, entity; and must not in any other way violate applicable federal, provincial or local laws and regulations, as determined by Canadian Pacific, in its sole discretion. Submissions may not contain indecent behavior, profanities or obscenities, including but not limited to nudity or pornography, and may not in any way disparage persons or organizations associated with Canadian Pacific. Sponsor/judges reserve the right in their sole discretion to disqualify any entry that, in their sole opinion, refers, depicts or in any way reflects negatively upon Canadian Pacific, the contest or any other person or entity, or does not comply with these requirements or these rules. Submissions may not contain third party content to which the entrant does not own the intellectual property rights, or to which the entrant has not received permission from the rightful owner. Entrants' submissions shall not contain material that infringes on the copyrights, trade-marks or other proprietary rights of third parties. Submissions must be suitable for presentation in a public forum, in sole determination of judges and/or Canadian Pacific. If the submission contains any person(s) other than the entrant, by entering this video contest, entrant agrees to receive permission from other person(s) featured in video (or from parent/legal guardian if other person(s) featured are considered minors in their province of residence) for Canadian Pacific to use their likenesses for publicity including posting on website(s) and can make written copies of such permissions available to Canadian Pacific upon request. Not all video submissions will be posted online. All decisions of Canadian Pacific with respect to any aspect of this contest, including without limitation the eligibility of entries, are final and binding on all entrants in all matters as they relate to this contest. Canadian Pacific reserves the right to vet the content of all submissions and to decide whether content is appropriate and complies with the rules of this contest. Canadian Pacific, acting reasonably and in its sole discretion, may disqualify any such submissions.
  15. Odds of winning the prize depend on the number of eligible entries received.
  16. All entries become the property of Canadian Pacific and will not be returned. Canadian Pacific shall own exclusive rights to the videos, including all intellectual property rights therein, and shall be entitled to the unrestricted use and dissemination of all submissions, or any part thereof, for any purpose, commercial or otherwise, without acknowledgement or compensation to any entrant. All entrants agree to execute and deliver all such documents, and shall take all such further or other actions as Canadian Pacific deems necessary or desirable, in its sole discretion, to carry out the foregoing.
  17. Prizes must be accepted as awarded. Prizes are non-transferable and non-redeemable for cash. Prizes may not be exactly as shown in promotional materials. In case of unavailability of any prize or for any other reason and in Canadian Pacific’s sole discretion, Canadian Pacific reserves the right to substitute a prize of equal or greater value.
  18. The awarding of the Grand Prize will be conditional upon the winner signing a declaration, publicity consent, waiver and release.
  19. By participating in this contest, all participants declare that they have read, understood and complied with the contest rules, consent to the use of their name, biographical information and/or likeness for the purposes of advertising and promotion without further compensation and agree to abide by all decisions of Canadian Pacific.
  20. By participating in this contest, all participants release Canadian Pacific, its affiliates, and their employees, directors, officers, representatives and agents from all liability for any damage that may result from entering or attempting to enter the contest. Participants agree to release and hold harmless Canadian Pacific, its affiliates and their employees, directors, officers, representatives and agents from any liability, loss or damage occurred with respect to the awarding, receipt, possession and/or use or misuse of the prize and acknowledge that Canadian Pacific and its affiliates, and their employees, directors, officers, representatives and agents have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, including but not limited to the quality, condition or fitness for a particular purpose of the grand prize.
  21. Canadian Pacific is not responsible for errors in the offer or administration of this contest, including but not limited to, errors in the advertising, the contest rules, the selection and announcement of the winner or the distribution of the Grand Prize.
  22. Canadian Pacific is not responsible for lost, late, illegible, incomplete, mutilated or misdirected contest entries.
  23. The contest is subject to all applicable federal, provincial, municipal and local laws and regulations.
  24. Personal information collected from entrants will be used by Canadian Pacific for the purpose of administering this contest. Canadian Pacific will not sell, share, use or otherwise disclose the personal information of entrants with third parties, other than to third parties engaged by them to fulfill the above purposes, without consent, or as permitted or required by law.

    By entering the contest, entrants consent to the manner of collection, use and disclosure of their personal information for the purposes of administering the contest, as set out in the Canadian Pacific Privacy Policy which can be viewed on the Canadian Pacific website at www.cpr.ca.   25. In Quebec, any litigation respecting the conduct or organization of this contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of the prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
  26. Canadian Pacific reserves the right to modify, suspend or cancel this contest, subject to the approval of the Régie des alcools, des courses et dex jeux in Quebec, if it determines that for any reason the contest cannot be run as originally planned or any other occurrence comprising the fairness or integrity of the contest. CP SPIRIT TRAIN CLUB: “WIN A CAMCORDER” CONTEST

    How to Enter
  1. Beginning on September 5th, 2008, participants who sign up to be a CP Spirit Train Club member online at www.cpspirittrain.com, will be entered into a random draw for a Panasonic camcorder. One CP Spirit Train club member will be selected at random by a representative of Canadian Pacific as the winner. Contest winner’s name will be posted online at www.cpspirittrain.com.
  2. NO PURCHASE NECESSARY TO ENTER.
  3. Participants are only eligible to enter once.
